Maximum Class Size---The average class size for
each grade span in a local school administrative unit shall at no time exceed
the funded allotment ratio of teachers to students. At the end of the second
school month and for the remainder of the school year, the size of an individual class shall not exceed the
allotment ratio by more than three students.

Maximum Teaching Load - Students shall be assigned to classes so that from the 15th day of the school year through the end of the school year the number of students for whom teachers in grades 7 through 12 are assigned teaching responsibilities during the course of the day is no more than 150 students, except as provided in subsection (g) of this section. G.S. 115C-301(d)
Alternative maximum Class Sizes - The State
Board of Education, in its discretion, may set higher maximum class sizes and
daily teaching loads for classes in music, physical education, and other similar
subjects, so long as the effectiveness of the instructional programs in those
areas is not thereby impaired. G.S.
115C-301 (e)
Penalty for Noncompliance- If the State Board of Education determines that a
local superintendent has willfully failed to comply with
the requirements of this section; no State funds shall be allocated to pay the
superintendent’s salary for the period of time the superintendent is in
noncompliance. G.S. 115C-301(i)
Calendar facts to support
your School Improvement Team and Plan
House Bill 1464 states that the opening date
for students shall not be before August 25, and closing date shall not be after
June 10. The opening and closing dates apply to instructional days only,
teacher workdays may be scheduled outside of these dates.
House Bill 1464 decreases the number of days
in the school calendar from 220 days to 215 days. This Bill does not affect General Statute 115C-84.2 which requires
the school calendar must
1.
have a minimum of 180 days and 1,000 instructional hours.
2.
cover at least nine calendar months.
3.
have a minimum of 10 annual vacation leave days.
4.
have the same or an equivalent number of legal holidays occurring within
the school calendar as those designated by State Personnel Commission for State
employees.
5.
not have Sunday as an instructional or staff work day.
6.
not have Veterans as an instructional or staff work day.
In addition, teachers are paid for a term of
10 months (GS115‑302.1) and therefore, the calendar shall not schedule
instructional days or workdays on a Saturday. A Saturday may be used as a
makeup day for an inclement weather day when the school has been closed.

Schools designated as having a modified calendar for the 2003-04 school
year or planned to have a modified calendar in 2003-04. This includes those
schools that have been identified by the
Year-round schools
Schools which are exempt due to a year round calendar must ensure that they are
designated as year-round in the School Name and Address file.
